Terms of Service

These Terms of Service (hereinafter referred to as the "Terms") set forth the conditions of use for the services (hereinafter referred to as the "Service") provided on this website by the operator of the Service (hereinafter referred to as the "Operator"). Registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.

Article 1 (Application)

  1. These Terms shall apply to all relationships between the User and the Operator concerning the use of the Service.
  2. In addition to these Terms, the Operator may establish various rules and provisions regarding the use of the Service (hereinafter referred to as "Individual Provisions"). Regardless of their name, these Individual Provisions shall constitute a part of these Terms.
  3. In the event that the provisions of these Terms conflict with the provisions of the Individual Provisions in the preceding article, the provisions of the Individual Provisions shall take precedence unless otherwise specifically provided in the Individual Provisions.

Article 2 (Registration for Use)

  1. With respect to the Service, registration for use shall be completed when a prospective registrant agrees to these Terms, applies for registration in the manner prescribed by the Operator, and the Operator approves such application.
  2. The Operator may not approve an application for registration if it determines that the applicant falls under any of the following grounds, and shall bear no obligation whatsoever to disclose the reasons therefor.
    1. When false information was provided in the application for registration
    2. When the application is from a person who has previously violated these Terms
    3. When the Operator otherwise determines that the registration is not appropriate

Article 3 (Management of User ID and Password)

  1. The User shall, at their own responsibility, properly manage the User ID and password for the Service.
  2. The User may not, under any circumstances, transfer or lend the User ID and password to a third party, or share them with a third party. When a login is made with a combination of User ID and password that matches the registered information, the Operator shall deem such use to be by the User who registered that User ID.
  3. The Operator shall bear no liability whatsoever for any damages arising from the use of the User ID and password by a third party, except in cases of willful misconduct or gross negligence on the part of the Operator.

Article 4 (Usage Fees and Payment Methods)

  1. As consideration for the paid portions of the Service, the User shall pay the usage fees separately determined by the Operator and displayed on this website, by the method designated by the Operator.
  2. If the User is in arrears in paying the usage fees, the User shall pay late payment damages at the rate of 14.6% per annum.

Article 5 (Prohibited Acts)

In using the Service, the User shall not engage in any of the following acts.

  1. Acts that violate laws and regulations or public order and morals
  2. Acts related to criminal activity
  3. Acts that infringe on the copyrights, trademark rights, or other intellectual property rights contained in the Service, including its content
  4. Acts that destroy or interfere with the functions of the servers or networks of the Operator, other Users, or other third parties
  5. Acts of commercially using information obtained through the Service
  6. Acts that may interfere with the operation of the Operator's services
  7. Acts of gaining or attempting to gain unauthorized access
  8. Acts of collecting or accumulating personal information about other Users
  9. Acts of using the Service for improper purposes
  10. Acts that cause disadvantage, damage, or discomfort to other Users of the Service or other third parties
  11. Acts of impersonating other Users
  12. Acts of advertising, promotion, solicitation, or business operations on the Service that are not permitted by the Operator
  13. Acts aimed at meeting unacquainted persons of the opposite sex
  14. Acts of directly or indirectly providing benefits to antisocial forces in connection with the Operator's services
  15. Other acts that the Operator determines to be inappropriate

Article 6 (Suspension of the Service, etc.)

  1. The Operator may suspend or interrupt the provision of all or part of the Service without prior notice to the User if it determines that any of the following grounds exist.
    1. When performing maintenance, inspection, or updates to the computer system related to the Service
    2. When the provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
    3. When computers or communication lines, etc. are stopped due to an accident
    4. When the Operator otherwise determines that providing the Service is difficult
  2. The Operator shall bear no liability whatsoever for any disadvantage or damage suffered by the User or a third party due to the suspension or interruption of the provision of the Service.

Article 7 (Usage Restrictions and Deregistration)

  1. The Operator may, without prior notice, restrict the use of all or part of the Service by the User or cancel the User's registration if the User falls under any of the following.
    1. When the User violates any provision of these Terms
    2. When it is found that there are false facts in the registered information
    3. When there is a default in the payment obligation of fees, etc.
    4. When there is no response from the User to a communication from the Operator for a certain period
    5. When there has been no use of the Service for a certain period since the last use
    6. When the Operator otherwise determines that the use of the Service is not appropriate
  2. The Operator shall bear no liability whatsoever for any damages incurred by the User due to actions taken by the Operator based on this article.

Article 8 (Withdrawal)

The User may withdraw from the Service through the withdrawal procedure prescribed by the Operator.

Article 9 (Disclaimer of Warranties and Limitation of Liability)

  1. The Operator does not warrant, either expressly or impliedly, that the Service is free from de facto or legal defects (including defects, errors, or bugs relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, etc., as well as infringement of rights).
  2. The Operator shall bear no liability whatsoever for any damages incurred by the User arising from the Service, except in cases of willful misconduct or gross negligence on the part of the Operator. However, if the contract between the Operator and the User regarding the Service (including these Terms) constitutes a consumer contract as defined in the Consumer Contract Act, this disclaimer shall not apply.
  3. Even in the case provided in the proviso of the preceding paragraph, the Operator shall bear no liability whatsoever for damages arising from special circumstances among the damages incurred by the User due to default or tort caused by the Operator's negligence (excluding gross negligence) (including cases where the Operator or the User foresaw or could have foreseen the occurrence of damages). Furthermore, compensation for damages incurred by the User due to default or tort caused by the Operator's negligence (excluding gross negligence) shall be limited to the amount of usage fees received from the User in the month in which the damages occurred.
  4. The Operator shall bear no liability whatsoever for any transactions, communications, or disputes arising between the User and other Users or third parties in connection with the Service.

Article 10 (Changes to Service Content, etc.)

The Operator may change, add to, or discontinue the content of the Service with prior notice to the User, and the User shall consent to this.

Article 11 (Changes to the Terms of Service)

  1. The Operator may change these Terms without the individual consent of the User in the following cases.
    1. When the change to these Terms conforms to the general interests of the User.
    2. When the change to these Terms does not contravene the purpose of the Service use contract and is reasonable in light of the necessity of the change, the appropriateness of the content after the change, and other circumstances related to the change.
  2. In making changes to these Terms under the preceding paragraph, the Operator shall notify the User in advance of the fact that these Terms will be changed, the content of the revised Terms, and the timing of their entry into effect.

Article 12 (Handling of Personal Information)

The Operator shall properly handle personal information acquired through the use of the Service in accordance with the Operator's "Privacy Policy."

Article 13 (Notice or Communication)

Notices or communications between the User and the Operator shall be made by the method prescribed by the Operator. Unless the Operator receives a notification of change from the User in accordance with a method separately prescribed by the Operator, the Operator shall deem the currently registered contact information to be valid and shall give notice or communication to such contact information, and these shall be deemed to have reached the User at the time of dispatch.

Article 14 (Prohibition of Assignment of Rights and Obligations)

The User may not, without the prior written consent of the Operator, assign their status under the use contract or their rights or obligations under these Terms to a third party, or offer them as collateral.

Article 15 (Governing Law and Jurisdiction)

  1. In interpreting these Terms, Japanese law shall be the governing law.
  2. In the event of a dispute regarding the Service, the court having jurisdiction over the location of the Operator's head office shall be the exclusive agreed jurisdiction.
